Case study Bharti & Walmart Essay

EXECUTIVE SUMMARY The case study is conducted to analyze the sustainability of the joint venture of Wal-Mart and Bharti in disregard of the fact that the two companies have split apart in late 2013. Therefore, the paper will be conducted by using the information given in the case material and course materials, with extra information related to statistics and government policies before the split up of the joint venture. Through the SWOT analysis and pros & cons analysis of the joint venture, it is crystallized that the joint venture was facing obstacles coming from intrinsic factors such as the challenge to maintain low cost leadership and the ability to adapt local market for Wal-Mart and extrinsic factors such as government policy, consumer behavior and poor infrastructure. The challenges Wal-Mart was facing couldn’t all be solved with the partnership. For instance, the market share and overall profitability were low due to the unsolved problems with Wal-Mart’s strategic orientation and the localization to the market, leaving uncertainty to the joint venture. Hence, among three alternatives of 1) Change strategic Orientation and re-positioning; 2) Improve corporate image and social responsibility and 3) Call off joint venture, it’s recommended for Wal-Mart and Bharti to maintain their partnership but to re-position the joint venture and localize themselves to the market. The recommendation would be further explained in the last section of this paper. PROBLEM STATEMENT Given the circumstance, the joint venture was facing challenges on the sustainability for different reasons. Wal-Mart has planned ambitiously for the joint venture, however it failed to achieve the goals of opening sufficient amount of stores in order to gain the market share and improve the margins due to the competence or willingness in localization, the government policies etc. Measures are needed for the two entities to take in  order to achieve profit growth whether to change the positioning/strategic orientation, improve the corporate image to achieve long term benefits or even to call off the joint venture since it’s no longer mandate for Wal-Mart to access the market through a partnership. ANALYSIS In order to tackle the most fundamental issues in Wal-Mart business journey in India, I’d like to first conduct a SWOT analysis of Wal-Mart’s retail business in India as following. Strength: 1. Scale of operations. Wal-Mart is the largest retailer in the world that no other retailer can match. Due to such large scale of operations, the corporate could exercise strong bargaining power on suppliers to reduce the prices. 2. Competence in information systems. The success of Wal-Mart in 21st century is largely due to its competence in information systems and supply chain management. However Wal-Mart’s advantage in supply chain management was shattered when it entered India. 3. Varity of products. Wal-Mart could offer wider range of products than local competitors. It has also been proven that Indian consumer would embrace affordable products with an upper standard of quality. 4. Low-cost leadership strategy. This strategy has helped Wal-Mart to become the low cost leader in the retail market. Weakness: 1. Inexperience in localization. Even though Wal-Mart was expanding its global appearance, it lacked experience in adapting its products and services to the specific demand of local market due to the domestic strategy. 2. Different shopping mentality. The Indian consumer mentality of â€Å"save and buy† was totally different from the American’s and Indian businesses were focusing more on B2B model, therefore the success of Wal-Mart’s B2C model was questionable. 3. Dependency of logistic system. Wal-Mart and its low cost leadership strategy are largely depended on an effective and efficient warehouse system which was not fully developed in India. 4. Lack of skilled employees. Wal-Mart would have to face the issues with unskilled employees while doing business in India and would potentially increase the training cost of employees. Opportunities: 1. Emerging retail market. Indian retail market grew by 5% in 2006, opening huge opportunities for Wal-Mart’s revenue growth, and the market was opened to Wal-Mart through joint venture. There was also existed an emerging demand of organized retailer. 2. Rising acceptance of foreign products. The increasing acceptance of high quality and low price foreign products opened the opportunities for Wal-Mart as well. In addition, the consumer disposable income and purchasing power was increasing. Threats: 1. Increasing resistance from local communities and retailers. Wal-Mart had a negative impact on local retailers therefore it faced considerably the political pressures from local communities due to the protection of local retailers. On the other hand, Wal-Mart faced the direct challenges from organized local retailers such as Pantaloon, RPG group etc. 2. Challenges from other MNCs. Other multinational corporations, such as Spencer’s Retail were also threatening Wal-Mart’s business in India. Given that some traditional advantages such as the efficient warehouse system were weakened in India, Wal-Mart’s domination in India would be shaken. Wal-Mart’s Challenges in India The opening of an emerging market with a rapidly growing middle class should create a promising future for Wal-Mart. However along with the opportunity are also challenges. After analyzing the SWOT of Wal-Mart, it’s very clear that Wal-Mart was facing challenge from extrinsic environment and intrinsic core competitiveness. Traditionally, foreign investors fail mainly because of the incompetence of maintaining their core competitiveness. But in India, Wal-Mart might be facing more of the external environment challenges. To begin with, retail industry was one of the few sectors where FDI was not allowed due to the protection of small and medium sized local retailers before 2012, forcing multinational corporations to seek a joint venture with a local partner rather than wholly-owned model as in other countries. Local communities worried that Wal-Mart would eliminate small retailers and intermediates who played important roles in supporting local economy. In addition, Wal-Mart cou ldn’t cover the job loss since the main strategy of the company was low-cost leadership which suggested that Wal-Mart would hire just-enough employees to maintain its operations and would cut the  middle-man in the process of procurement in its supply chain. The Indian government requires foreign retailer to source 30 per cent of its goods from small supplier with objectives to discourage imports by foreign retailers from their few large dedicated suppliers and to weaken Wal-Mart’s bargaining power and make economic growth becomes sustainable1. Moreover, with an aggregate score of 2.5, India ranks 64th in market openness and is largely due to the fast real import growth, according to International Chamber of Commerce (2013). India has its weakest score in trade policy (2.0) which is also the second to last score among G20 nations (see table1). From a cultural aspect, the Indian consumers have a different mentality of â€Å"save and buy† thus traditionally Indi an businesses were focusing more on B2B model. Dealing with foreign authorities requires finesse and charm, and given that lobbying was forbidden in India, Wal-Mart might not be able to influence the government policies in an official way and Wal-Mart should avoid seeking inappropriate channel to reach the local authority such as bride. As for intrinsic competitiveness, Wal-Mart was facing problem with losing its traditional advantages. To begin with, the national differences would continually question Wal-Mart’s ability to adapt itself to the market since Wal-Mart had less experience in foreign market. Given that the road infrastructure and the modern supply chain system were not fully developed in India (see table 2), Wal-Mart would face the inefficient transportation in its supply chain. In addition, Wal-Mart would need to associate with local partners in order to solve the warehouse shortage and poor infrastructure. As a result of the lack of skilled labor, labor producti vity in Indian retail market should be lower and Wal-Mart would have to increase its spending on employees’ training and therefore it would be challenging for Wal-Mart to maintain its advantages in low-cost leadership in India. Finally, Wal-Mart stores were competing with entrenched local general merchandise and food merchants, potentially leading to unprofitable for the company. Joint venture with Bharti Given the circumstances, it’s logically for Wal-Mart and Bharti to form a joint venture. In the rapidly growing organized retail market in India, Wal-Mart and Bharti were able to leverage the needs and assets of each other’s (see table 3). For Bharti, one advantage of this joint venture is  that since the management of Wal-Mart promised to lead the liberation of retail market, it would be beneficial for both two parties and India as well. From the same perspective, Wal-Mart was a particularly attractive partner to Bharti for the strength of Wal-Mart in information technology and supply chain management knowledge that could turn around the infrastructure, supply-chain and IT through a strategic alliance (Bose, 2012). As for Wal-Mart, through the 50/50 venture for backend supply chain management and wholesale cash-and-carry operations, (Bose , 2012) Wal-Mart was able to utilize Bharti’s domestic facilities as a jump board to the emerging market and it was able to bypass some restrictions that were harmful to its business. With Bharti’s deep knowledge of India’s fast-growing market and its prior foreign experience of cooperate with other foreign firms (Bose, 2012), Wal-Mart would have a smooth start in the early stages of the joint venture (Luo, 1998). By increasing its purchase from local suppliers and associating with prestige local firm, Wal-Mart could also possibly change positively the consumer perception on itself. However, there were also many disadvantages brought by the joint venture. First, it took time and efforts for both parties to form the joint venture, meaning Wal-Mart might take longer time to expand compared with using wholly-own model. In this joint venture, Wal-Mart and Bharti would deliver a mixture of brand image which might confuse the consumers, and the local partner might take advantage from this mixed message and knowledge transfer as mentioned before. As a result, this joint venture had the possibilit y of creating a new competitor for Wal-Mart. As mentioned before, one of the biggest problems Wal-Mart had was from the government regulation which either of the two parties could lobby the government. In addition, the financial situation of Bharti Enterprises was not a positive factor in their joint venture, for its debt was at a high level and affected negatively the cash flows of the joint venture. Both companies had complementary strengths they were able to utilize to expand in India in a long term. By leveraging each other’s expertise, both entities were able to use and build upon best practices that had proven successful for both companies in their individual ventures, performing better than either company could do alone in the growing Indian retail market. However, since many disadvantages remained for Wal-Mart and Bharti and the fact that they haven’t acquired the expected market share, the future of this joint  venture was in vague. Hence, the two companies should focus on the sustainability of the joint venture. In this regard, both two parties should take measures to reassure the sustainability of their joint venture and improve its performance accordingly. According to Dr. M.N.H. Mazumder, there are three traits that MNC should consider when selecting local partner, strategic traits, organizational traits and financial traits. Therefore, the sustainability of the joint venture would also be dependent on the fits of these traits. For instance, in terms of strategic fits, by establishing a mutually satisfied, efficient, and productive trustful partnership with Bharti, Wal-Mart would be very likely to maintain a common goal so that the joint venture could avoid the risk of being sabotaged by the dysfunctional conflicts between the two partners. In the following section, we’ll be discussing the details of alternatives that could help in the sustainability. ALTERNATIVES: Alternative 1- Change the strategic orientation and re-positioning In 2007, Wal-Mart announced with ambitious that partner with Bharti, it planned to open hundreds of stores, it has quietly shelved its expansion plans after complex market conditions. In 2012, Wal-Mart opened just five wholesale stores in India last year while it planned to open 22 stores. In addition, while Bharti wished to open more small traditional stores or cash and carry business due to the fragmented market and consumer behavior, Wal-Mart was pushing its large retail stores which usually take 24 months to open. Therefore, since Wal-Mart struggled to gain market share, it should be carefully examine its expansion plan and consider Bharti’s perception on the market. Alternative 2- Improve corporate image and social responsibility As stated, Wal-Mart was facing obstacles brought by its corporate image and it has been criticized for eliminating local business and leading to higher unemployment. By operating a public relation campaign and fulfilling its social responsibility in education, agriculture (assisting local farms) etc, Wal-Mart should be able to change the stereotype perception of foreign investors and establish a good foundation for less challenges from the local society. However, this alternative wouldn’t enable Wal-Mart and the joint venture to expand its market share in a short term. Therefore it’ll require both two parties to have coherence on campaign cost and long term revenue. Alternative 3- Call off joint venture Bharti Enterprise has been struggling under a debt of USD 12 billion of its mobile business. Bharti’s liquidity would directly affect the joint venture’s ability to pay off short term financial obligations. Also considering that Wal-Mart is allowed to the 100% ownership in a retail company in India, it’d also be an alternative for two parties to split and do business alone. It’s possible that Wal-Mart will lose its market share in a very short future due to the losses of information and suppliers in this split up. RECOMMENDATIONS It’s recommended to maintain the joint venture, but changes are needed in the strategic orientation and the positioning. For the joint venture and mostly for Wal-Mart, building convenient stores and therefore establishing a larger presence in the Indian market are crucial to the sustainability and profitability. In order to solve extrinsic problems such as the consumer behavior of purchasing on a daily basis rather than buy a weekly portion, it’s more flexible for Wal-Mart if it could have smaller stores covering more locations and it would be positive to consumer loyalty with larger presence in different regions, though thorough research on the target consumer markets would be needed in order to offer Indian consumers the type of products they desire at the appropriate quantity and location. In addition, opening smaller stores would require two parties to work collectively and more productively on their supply chain management due to the complexity brought by more stor es. Gammasonics Institute for Medical Research Pty Ltd

Gammasonic v Comrad[1] demonstrates the reluctance of the courts to interpret the Sale of Goods Act to include software downloads as a â€Å"good†, preferring to leave the matter up to statutory review. It primarily discusses whether a software package delivered by online download is effectively classed as â€Å"goods† for application of Sale of Goods Act[2] and outlines the progressive court decisions that have considered the question and have begun to recognize software attached to a medium, like a cd package as a â€Å"goods†. It also briefly addresses the applicability of statutory warranties of fitness for purpose and merchantable quality and supports that fitness for purpose and merchantable quality are implied by common law giving reference the test for implication in fact outlined in BP Refinery (Westernport) v Shire of Hastings (1977)[3] Background and overview The disputing parties are Gammasonics, a provider of services to radiologists in NSW, and Comrad, a business that provide software and information management systems to radiologists in Australia and New Zealand. The dispute concerns a contract between the parties for the delivery and installation of a software package via remote internet download called â€Å"Comrad RIS†; which was to manage workflow, patient registration and appointments, online referrals and processing of Medicare claims for Gammasonics. The software was downloaded onto Gammasonics’ server and Gammasonic were purportedly responsible for hardware configuration and the network infrastructure specified to run the software. Comrad delivered the software via internet download and certain areas of the software did not function as required. Gammasonics claimed to terminate the contract for breach of terms including â€Å"failure to deliver a functioning software package, failure to provide goods of a merchantable quality and/or for the delivery of a software package which was not fit for its intended purpose.† [4] Comrad in turn sought an award for damages due to the repudiation of the contract by Gammasonic. Trial Proceedings This case is an appeal from Local Court against orders made by Magistrate Quinn in favour of Comrad for the amount of $58,011.21. There Magistrate Quinn was not convinced the software supplied by Comrad was a â€Å"good† as defined in s5 of the Sale of Goods Act 1923[5] and â€Å"held the act did not apply†[6]. She also found Comrad failed in the delivery of certain components required for the software functioning; however it was stated that it was â€Å"Gammasonics' own acts or omissions and not any conduct for which it had contractual responsibility that rendered the system unworkable, such that Gammasonics’ purported termination was a repudiation of the contract thereby entitling Comrad to sue for damages.†[7] Material Issues The following are the key issues that arise from the judgement and contain the essential elements of the case which will be discussed in this case note. 1. Whether a software package delivered by online download is effectively classed as â€Å"goods† for application of Sale of Goods Act.[8] 2. Whether equivalent terms of fitness for purpose and merchantable quality are implied by common law. 3. Breach of essential terms The matter of whether a breach of contract is a question of mixed fact and law is also addressed in this case but it will not be extensively discussed within this case note. Whether a question of mixed fact and law arises was dealt with early in the case and Fullerton J was satisfied that the question of whether her Honour erred in holding that Comrad was not in breach of the contract, involved a question of mixed fact and law and as such leave to appeal ought be granted. Comrad also filed a notice for contention on two points one concerning the implication of terms into the contract equivalent to the statutory warranties of merchantable quality and fitness for purpose, the other on the question of breach. The Sale of Goods Act 1923 The definition of goods provided in the Sale of goods Act 1923 (NSW) s5(1) is Goods include all chattels personal other than things in action and money. The term includes emblements and things attached to or forming part of the land which are agreed to be severed before sale or under the contract of sale. It was submitted by Gammasonics that the software provided by Comrad was within the statutory definition of â€Å"goods† and they relied among other things on the implied condition as to quality or fitness in the act outlined in s19.[9] On appeal a request was made to consider whether there was a â€Å"Fresh Analysis of Authorities†[10] with a more modern approach to interpretation of the Act. Whether a software package delivered by online download is effectively classed as â€Å"goods† for application of Sale of Goods Act.[11] The case gives a thorough analysis and contains a comprehensive list of authorities that include case law and secondary sources which have reviewed this question. The key area of difference noted was that the software was delivered by download onto a server. This distinguished the case from that of others including Toby Constructions Products Pty Ltd v Computa Bar (Sales) Pty Ltd[12] where the software was held to be a ‘good’ because it comprised both software and hardware. Gammasonics relied on a passage from Advent Systems Ltd v Unisys Corp [13] as authority where an analogy was drawn to musical compositions and music on cds suggesting that once the software had been downloaded to the server it became a tangible thing. However the common thread is that software provided on a disc falls within the statutory definition of a ‘good’ while remote download via a license it appears currently does not. The case Fullerton J considered most analogous to the facts was St Albans City. [14] In this case the question of whether the transfer of the software, without the sale of the disk would give rise to a sale of â€Å"goods† under the Sale of Goods Act 1979 (UK) was considered by Sir Glidewell. There the disk was likened to an instruction manual however again the distinction is made between the delivery of the software via disk format and remote download a distinction that was also noted by Sir Glidewell. An Australian case that revisted the question was Re Amlink Technologies Pty Ltd and Australian Trade Commission[15] this case did not follow the reasoning offered in St Albans City[16] by Sir Glidewell and considered the proposition taken to the extreme would see goods being defined in areas that where never meant to be covered by the act. Secondary sources were further considered as Gammasonics highlighted what they supported to be a ‘growing trend’ in Australia to recognize software as a ‘good’[17] The recent Trade Practices Law Journal article by Svantesson discussed the stages of development citing Toby Constructions[18]as the first step taken in recognition of software sold together with hardware as a good. The article also highlighted the decision in Amlink Technologies[19] to recognize software attached to some physical medium and suggested the next logical step for the courts was to further recognize software not attached to a physical medium. A passage from a conference paper was also considered[20]where the distinction is made that where a customer purchases a digitized version of an encyclopedia it is a good however where it purchases access to the encyclopedia database it is a supply of a service. The facts of this case are most like that of the first scenario and the plaintiff submitted that the authorities support the conclusion that the software provided by Comrad is a ‘good’ under the act[21] It fell however to the principals of statutory interpretation in particular the everyday meaning of goods and possession. Comrad submitted that the ordinary meaning and any interpretative words referred to things that are tangible; therefore, â€Å"because lines of computer code are intangible the position contended for by Gammasonics was inconsistent†.[22] Fullerton noted that it was preferable to give protection to consumers purchasing software by digital download and noted that research suggests that this is an increasing form of delivery means but stressed the need for legislative reform[23] in the area not judicial intervention and found that the Sale of Goods Act did not apply. Whether equivalent terms of fitness for purpose and merchantable quality are implied by common law. The case also outlines that common law terms as to fitness for purpose and merchantable quality can be implied. This is in accordance with test for implication in fact [24] from BP Refinery (Westernport) v Shire of Hastings which is: 1) it must be reasonable and equitable; (2) it must be necessary to give business efficacy to the contract, so that no term will be implied if the contract is effective without it; (3) it must be so obvious that â€Å"it goes without saying†; (4) it must be capable of clear expression; (5) it must not contradict any express term of the contract†. Although the test was ultimately not considered. Breach of Essential Terms With regard to the breach of essential terms two main areas were readdressed. The interfacing with Medicare and network incompatibility. In both cases the documentary evidence was reviewed. While the plaintiff submitted that the findings of the Local Court were in error and that Comrad was responsible for both resolving the problems of interfacing with Medicare and for creating the interfacing problems. Comrad failed to provide sufficient evidence to support these claims and Fullerton J was not satisfied that Quinn J was in error therefore the appeal was dismissed. Effect on Current Law This case has been referred to in a recent journal article discussing when ‘software is a good’.[25] It has also been referenced in the recent edition of Australian Commercial Law[26] as the authority for the principal that software delivered online does not constitute a good, within the meaning of the Sale of Goods Act[27]. The case highlighted the need for legislative review in regard to the status of computer software and with the introduction of new legistlation The Australian Consumer Law (ACL) it has finally been decided that for the purposes of the ACL software is now specifically included within the definition of goods [28] affording consumers protection under s54 Guarantee as to acceptable quality[29] and s55 Guarantee as to fitness for any disclosed purpose.[30] It also shows the courts reluctance for judicial intervention on matters that may have wider applications in the interpretation of legislation and illustrates the progressive nature of the courts to effect change.

Everyone Has a Right to Choose Euthanasia    Everybody faces death eventually. While some people abhor the impending experience, others may await it excitedly. Regardless of one's expectations, most people do not wish for a painful end. If a situation arises where one must make a decision concerning approaching death or the death of loved ones, most people would hope for the least possible suffering. While a decision like this is extremely difficult to make, many people choose death as opposed to living in agony. However, others think that euthanasia is reprehensible no matter what the circumstances are. Author Cheryl Eckstein believes, "Killing in the name of compassion and mercy is wrong" ("Can there ever", par. 9). Homicide and suicide are generally not considered fair or sensible, but sometimes, however, they are carried out as acts of kindness and love. Thus, in certain situations, euthanasia may not be morally wrong. Eckstein states, "No person is entitled to have death inflicted upon him" ("Can There Ever", par. 11). However, if a person chooses death in order to prevent prolonged pain and misery, it is being self inflicted, and should not be denied in certain situations. People facing death should have a say in what happens to them. If a person is not physically or mentally able to make this decision, it seems most considerate that their loved ones should be able to aid in this process. If someone's remaining days are being spent in agony, shouldn't others attempt to fulfill their last wishes? On the other hand, Colleen McCullough says, "While there's life, there's hope" (Why I Oppose, par. 15). However, a drastically ailing being who is forced to keep living undesirably probably has limited hope. "The Boy in the Striped Pajamas" explores the beauty of a child's innocence in a time of war: Bruno, an eight year old boy at the time of the war, is completely oblivious to the atrocities of the war around him - even with a father who is a Nazi commandant. The title of the book is evidence to this - Bruno perceives the concentration camp uniforms as "striped pajamas." Further evidence is the misnomers "the Fury," (the Furher) and "Out-With" (Auschwitz). Bruno and Shmuel, the boy he meets from Auschwitz, share a great deal in common but perhaps what is most striking is the childhood innocence which characterizes both boys. Bruno is unaware that his father is a Nazi commandant and that his home is on ther periphery of Auschwitz. Shmuel, imprisoned in the camp, seems not to understand the severity of his situation. When his father goes missing, Shmuel does not understand that he has gone to the gas chamber. However, there is another facet to this beauty: "Where ignorance is bliss, 'tis folly to be wise" - so says Thomas Gray. In reference to this novel, it means that the people that lived in the vicinity of the concentration camp claimed to not know what was going on in the camp, so they could be "blissfully ignorant" of the Holocaust happening around them. This means that they did not have to live with the guilt of knowing what was going on and not doing anything. That is why they would be called "blissful". The quote means that if we are ignorant of something, we don't have to deal with it and are therefore happy. In the modern world, there are few places where this situation exists anymore, however. So, too, in World War II. We didn't have the Internet then, but there were other ways to find out what was going on in Nazi Germany. Do you think it is feasible that the Germans did not know what was going on? Do you think they were "blissful" because they were ignorant of the situation? A lot of them tried to claim this after the war was over. "We didn't know!" Most people do not buy this. How could they not know? Come on! The stench of burning bodies was everywhere.

Use of Satire in Kurt Vonnegut's Cat's Cradle Kurt Vonnegut said in The Vonnegut Statement (1973), in an interview with Robert Scholes, that one of his reasons for writing is "to poison minds with humanity†¦to encourage them to make a better world" (107). This idea works quite well in Vonnegut's book, Cat's Cradle. It is a satirical story of a man's quest to write a book about the day the world ended (refering to the day the atomic bomb was dropped on Hiroshima), which he never finishes. What we get is a raw look at humans trying desperately to find a sense of purpose in their lives through different means such as religion, science, etc. Vonnegut uses satire that is both dark and humorous to pursue this point. A good example is found in the prelude of the book where he writes, "Nothing in this book is true. 'Live by the foma [Harmless untruths] that make you brave and kind and healthy and happy.'" Bokonon, we learn, is a religion that is made up of "bittersweet lies" (12). "Truth was the enemy of the people, because the truth was so terrible, so Bokonon [the creator of the religion] made it his business to provide the people with better and better lies" (118). We also learn that science takes the opposite opinion. One of the men who helped develop the atomic bomb tells us, "The more truth we have to work with, the richer we become" (36). I think one thing that Vonnegut is trying to show us is that man too easily accepts things as valid without questioning. Refering to this, Newt, another character, says, "No wonder kids grow up crazy. A cat's cradle is nothing but a bunch of X's between somebody's hands, and little kids look and look and look at all those X's†¦No damn cat, and no damn cradle" (114). Cat's Cradle is full of these kinds of "poisons" not only about religion and science, but also about many other human frailties as well. In a way, Vonnegut is holding a mirror (that hides no imperfections) up to humanity in order that humanity might see its own the folly and futility and thus be impelled to try and improve. I think Vonnegut's hope is that this book will allow people to laugh at themselves while also making them think about how they are directing their own lives.

1. Title: ALL QUIET ON THE WESTERN FRONT 2. Author: ERICH MARIA REMARQUE 3. Published: 1929 4. SUBJECT: This book is written by a German veteran of World War I, who describes the German soldiers’ extreme physical and mental stress during the war, and the detachment from civilian life felt by many of these soldiers upon returning home from the frontlines. 5. OPINION: I think this book tells a tale of honor and courage, two of the three core values of the Marine Corps. The author brings his own experiences to light through the main character, Paul Bà ¤umer. Furthermore, I believe that the author is trying to characterize his generation, the young men who fought the Great War and who were destroyed by it. The group of men which Paul Bà ¤umer fights with reminds me of the camaraderie that lies within the Marine Corps ethos. 6. INTRODUCTION: All is Quiet on the Western Front begins with Paul Bà ¤umer’s company at rest, five miles behind the front lines between Langemark and Bixschoote. They have had very little sleep for the fourteen days since they relieved the front line and seventy of their one hundred and fifty men are dead at the hands of Russian gunfire. The cook, Ginger, has fixed rations for the one hundred and fifty and, after arguing with the lieutenant, grudgingly consents to give all the food to the eighty soldiers left, including double rations of smokes. As the narrator remarks, â€Å"Today is wonderfully good.† In All Quiet on the Western Front, Erich Maria Remarque creates Paul Bà ¤umer to represent a whole generation of men who are known to history as the â€Å"lost generation.† Eight million men died in battle, twenty-one million were injured, and over six and a half million noncombatants were killed in what is called â€Å"The Great War.† Throughout the story, I feel that the generation has gone through an event that steals the memories of their childhood. As early as the second chapter, Paul Bà ¤umer describes the difference between his generation, his parents, and the older soldiers. They had a life before the war, a life where they felt comfortable and secure. But Paul’s generation never had a chance at that life. Even when the story begins, all Paul has known is death, horror, fear, and suffering. He and his fellow classmates are only nineteen and twenty years old; the age of the average Junior Marine today. However, they feel nothing, believe in nothing, and see no future because of their experiences in the war. Apart from being deprived of the sweet memories of childhood and the hopes of a bright future, this generation felt a terrible sense of betrayal by their parents, teachers, and government. The myths of the older generation become apparent when Paul goes home. A sergeant-major reprimands Paul for not saluting him when Paul has spent a good share of his life in the trenches killing the enemy and trying to survive. Many Marines can relate to this reference, as many find it difficult to transition back into garrison after being in country for so long. As the war story unfolds, Paul and his friends become cynical towards death and horror all around them, that the inhumanity and atrocities of war become part of everyday life. The author describes the atrocities, the terrible consequences of weapons of mass destruction, and how soldiers become hardened to death and its onslaught of sensory perceptions during battle. Atrocities are simply a part of the inhumane business of war. In chapter 6, Paul and his men come across soldiers whose noses are cut off and eyes poked out with their own saw bayonets. Their mouths and noses are stuffed with sawdust so they suffocate. This constant view of death causes the soldiers to fight back like animals. They use spades to slice faces in two and jab bayonets into the backs of any enemy who is too slow to escape. Their callousness is contrasted with the reaction of the new recruits who give in to front-line foolishness described over and over again in scenes of the front. Despite all the terrible stories of death and gore, the author revisits a redeeming quality: comradeship. When Paul and his friends ambush Corporal Himmelstoss and beat him up, I laugh because he deserves it and they are only giving him his due. As time goes by, however, the pictures of camaraderie relieve the terrible descriptions of front line assaults and death, and they provide a bright light in a place of such terrible darkness. A recruit becomes gun-shy in his first battle when a rocket fires and explosions begin. He goes to Paul and cries and Paul does his best to comfort him. This reminds me of when I was deployed and my fellow Marines would make me feel better and tell me we would be home soon when I was feeling homesick. Through thick and thin, battle and rest, horror and hopelessness, these men hold each other up. Finally, Paul has only Kat and he loses even this friend and father-figure in Chapter 11. This man, this hero, this father, this life — has been closer to Paul than his own blood relatives and yet Paul must say, â€Å"No, we are not related.† Remarque says that this novel â€Å"will try simply to tell of a generation of men who, even though they may have escaped shells, were destroyed by the war.† If words can touch what men hold to be dear in their hearts and so cause them to change the world, this book with its words of a lost generation, lost values, and lost humanity is surely one that should be required reading for all generations. LESSON: I think that this book is great insight into what soldiers went through during World War I. It really captures the essence of basic Marine Corps Values, such as honor and courage. The main character Paul Bà ¤umer shows great courage in that he takes care of his fellow soldiers and pushes forward, despite all the day to day atrocities. Paul and his friends show honor by sticking up for what is right and being there for one another. Lastly, my favorite quality displayed by the characters was camaraderie. This is something that Marine Corps has taught me and that will always remain with me even after I get out, because it has showed me that no matter what, your peers will always be with you, during wartime and during peacetime.

CHAPTER I INTRODUCTION Background of the Study The Student Collegiate Record or SCR is playing an increasing role in the working stratagem of registrars. It enables them to hold and access the information of students like name, student number, date of birth, citizenship, gender, parents or guardian, occupation, permanent home address, schools graduated, course, year, subject, total number of units and final grade. The registrar records, edits and keeps all the information of old and new students thereby making the school's operations streamlined and effective.The existing SCR at AIE College International – Laoag Campus makes use of enrolment forms to obtain the necessary details from the enrollees. After which, the registrar records and saves these information in MS Excel. The registrar keeps each of the student’s records with a number attached (ex. IL-11-000478). The first two letters which is â€Å"IL† represents the AIE branch designation, the â€Å"11† numeric sign represents the year the student was enrolled and lastly â€Å"ex. 000478† represents the student number. Each student is only given one student number during the course of his education.The registrar then stores the hardcopy of files in bookshelves and the softcopy is kept in the computer. However, the registrar processes the information of the students individually so it takes a long period to finish all the papers. The registrar said that dealing with the student’s records manually is at times unmanageable because of the bulk of files to be checked one by one. The files’ security and confidentiality are also an issue since they are susceptible to access by unauthorized people and can be destroyed by unexpected circumstances.With this case, we proposed the â€Å"Registrar’s Student Collegiate System of AIE College International-Laoag Campus† to help the registrar minimize the time consumed in generating the records and information of the students. It will provide efficient enrollment process because it can track the subjects that the students have to take. It will be capable of storing, updating and securing the academic record of the students and through this, it will produce a more reliable and accurate students’ report. American Transcendentalists Essay

American transcendentalists sought the permanent spiritual reality behind physical appearances. They were optimistic and believed in human perfectibility; they engaged in projects that tried to create the ideal reality. They believed that the universe is one great entity. Transcendentalism centres on the divinity of each individual. But this divinity could be self-discovered only if the person had the independence of mind. They believed in democracy, equality, the unlimited power of the individual and the beauty of the human spirit and the natural world. They focused on the positive aspects of life, while working to improve the injustices of the world. Transcendentalists’ view on Nature is unique and interesting. They believe that there is an inner spark contained by and connecting all facets of nature, including mankind, which can be discovered not through logical reasoning but only through intuition and the creative insight. They stressed the importance of harmony with nature.   Transcendentalism is an idealism that encompasses a diverse and sometimes confusing set of beliefs regarding man’s role in nature and the universe. As for the human nature, transcendentalists saw no need for any intercession between God and man and therefore called for an independence from organized religion. They stated that God is energy, a force, not a particular separate being; God breathes through nature and man attempts to open himself up to this influx. Their claim was that the divinity is self-contained in every being. They believed in the unlimited potential of human ability to connect with both the natural and spiritual world. People should, through their intuition, the external symbols of nature and translate them into spiritual facts. Transcendentalists were idealistic and optimistic because they believed they could find answers to whatever they were seeking. Transcendentalist declared there was meaning in everything and that meaning was good and connected by and parts of a divine plan. This philosophy led to an optimistic emphasis on individualism; one aspect of individualism is the value of the individual over society. One must follow his instincts and not conform to what society dictates. Although society will influence an individual towards conformity, it is important to remain true to one’s self and to one’s identity. Transcendentalism believes the spiritual reflection of each person as they move from the rational to the spiritual is the very essence of life, and this is an individual accomplishment. Thoreau stated that the world around us as a miracle in itself. It is in this living we move toward the conscience of the reality we cannot see, and this is part of Thoreau’s point. Thoreau argued in Walden that the divine exists not just in all people but can be perceived in all of nature. The idea of immanence served to strengthen Thoreau’s belief in the equality of all people â€Å"Heaven is under our feet as well as over our heads,† cited Thoreau in Walden. â€Å"Superfluous wealth can buy superfluities only,† is another valuable quotation from his book. Transcendentalists believed in individual creative spirit and empathized natural way of life. Thus, transcendentalists were extolling the spiritual benefits of living in nature. Thoreau believed that â€Å"most men live lives of quiet desperation,† and he wanted to show the humanity a way out. Anti-transcendentalists rejected the optimistic outlook on humanity and life declaring that the optimism of their predecessors was naà ¯ve and unrealistic.   The anti-transcendentalists reflected a more pessimistic attitude and focused on man’s uncertainty and limited potential in the universe. The writing of anti-transcendentalists focuses on imagination, intuition, the power of nature and individual emotion, but they deal with the darker side of human nature. The anti-transcendentalists viewed nature as vast and incomprehensible, a reflection of the struggle between good and evil. The anti-transcendentalist felt humans were depraved and had to struggle for goodness.  Although they thought goodness was attainable for some, they believed in evil as its own entity. They believed sin was an active force; it was not just the absence of good; they really did think, on some level, that the devil existed. The anti-transcendentalists believed in a higher authority and that nature is ultimately the creation and possession of God and can not be understood by humans. The anti-transcendentalists feared that people who desired complete individualism would give into the worse angles of man’s nature. They were concerned that without external constraints, such as societal mores, people would be motivated only by their immediate need and desire for sensory gratification. They believed that both nature and human nature had a dark side that could not be ignored. Anti-transcendentalist writer would hold readers’ attention through dread of a series of terrible possibilities and feature landscapes of dark forests, extreme vegetation, concealed ruins with horrific rooms, depressed characters. Melville’s perspective on life is that God created the universe with an infinite number of meanings and man is always trying to determine one specific meaning. The writer believed the single-minded idealist could draw society into danger. Melville illustrated this fault through his main character, Ahab, who embarked on a journey to avenge the whale that dismasted him. Ahab had excessive pride, which blinded his common sense and endangered his crew as he set out on a futile mission of revenge. When Ahab said, â€Å"I would strike out at the sun if it insulted me. Who’s over me?† † it showed his transformation into a single-minded idealist. In this story the whale, Moby Dick, serves to symbolize any force that we allow to hold us back. Melville, through symbolism in the story, taught the moral that when human beings have few external constraints, their inner needs and drives serve as their motivation. He also warned of the inherent dangers in a person such as Captain Ahab. On the contrary, Ishmael’s character allows the reader to relate to a love for nature and the earth, as well as a feeling of inner peace and serenity. The â€Å"man vs Nature† is one of the central in the book. This conflict contradicts totally the notion about the integrity of humankind and natural world. Still, Melville gives credit to natural world, while referring to it as to the, â€Å"God’s great, unflattering laureate, Nature.† But in his writing the integrity and spiritual fullness of Nature is questioned, his approach is more scientific than philosophical. Hawthorne was another representative of anti-transcendentalist trend in American literature. In Dr. Heidegger’s Experiment an invitation to taste from the fountain of youth is offered. Four Heidegger’s friends agree to do so and they become young again, but they are soon devastated by the transience of the experience. Again, the motif of the uncontrolled power of the science is central in the story. Another contradiction between transcendentalists and their opponents concentrated around the concept of self-reliability. For instance, Hawthorne saw the self-reliant person as selfish, insecure, and desperate for attention. The need for a person to depend on society is as great as the need for society to depend on the individual. But the term â€Å"society† in the story has more specific application. â€Å"Society† is the familiar circle, the system of social relations of each individual. By becoming suddenly young, people endanger themselves of loosing their familiar circle of friends and acquaintances. Hawthorne depicted people who had no regard for societal values at all; he was among the first to introduce the problem of ethic of science. As for the human nature, Dr. Heidegger advices his friends that they should, â€Å"think what a sin and shame it would be, if, with your peculiar advantages, you should not become patterns of virtue and wisdom to all the young people of the age.† The issue of sin has attracted many anti-transcendentalist writers. So we mak3e a conclusion that transcendentalist authors had optimistic view of life and believed in the spiritual nature if the world and integrity of Man and Nature, they put on emphasis over individualism and self-reliance. Anti-transcendentalists had more pessimistic view on life and concentrated on the darkest side of human nature.
